Deliberations of the Scientific Council at the SME Ombudsman, consideration of a 4-day working week and the impact of KSeF on SMEs

The main topic of discussion at the meeting of the Scientific Council of the Ombudsman for Small and Medium-Sized Enterprises, attended by Paweł Kossecki, was the introduction of a 4-day working week. The meeting discussed the potential social and economic consequences of such a change. On the one hand, such a regulation could bring benefits in terms of employee efficiency, but on the other hand, it would require thorough analysis on many levels (including costs, productivity, and the competitiveness of Polish companies on international markets), as well as proper implementation. Implementation will be easier for companies with so-called task-based working hours.

Another issue discussed in relation to the activities of SMEs was KSeF. Faced with the challenge of implementing the e-Invoice system for small enterprises, the negative effects that may occur were discussed (including increased employment costs, decreased competitiveness of companies, new obligations, and increased time required to issue invoices for small entities). Therefore, measures are being taken to delay the introduction of the program for this group of enterprises by up to two years. This will be sufficient time to fully adapt internal processes to adopt KSeF in an accurate and orderly manner.

 

The next Council meeting will feature a discussion on the JPK_CIT reporting obligation for the SME sector. This is a new challenge involving the requirement to periodically send structured data from accounting books (JPK_KR_PD) and fixed asset and intangible asset records (JPK_ST_KR) to the tax office. The problem for small businesses is mainly related to the need to adapt IT systems, map accounting accounts (assign tags), and reorganize processes to ensure that the data sent is consistent with the requirements of the regulations. For many SMEs, this will not only be a major organizational challenge, but also a significant financial burden, as it will require investment in new IT solutions and staff training.
